1. Agreement to Terms
These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User”, “you”, “your”) and GENTIQ UG (haftungsbeschränkt) (“GENTIQ”, “we”, “us”, “our”), governing your access to and use of the GENTIQ mobile application and related services (collectively, the “Service”).
By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
2. About GENTIQ
GENTIQ is a private style intelligence platform available as an iOS application. The Service allows users to build a digital wardrobe, receive AI-powered outfit recommendations, and virtually try on clothing. GENTIQ is developed and operated by GENTIQ UG (haftungsbeschränkt), registered in Austria.
3. Eligibility
You must be at least 16 years of age (or the applicable age of digital consent in your jurisdiction) to create an account and use the Service. By registering, you represent and warrant that you meet this age requirement. If we become aware that a user is under the minimum age, we will terminate their account and delete their data promptly.

To access the Service, you must create an account using either an email address and password or Sign In with Apple. You agree to:
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.
5. Subscription and Payments
5.1 Free and Premium Tiers
GENTIQ offers both a free tier with limited features and a premium subscription that unlocks the full experience, including unlimited outfit generation, virtual try-on, and advanced style features.
5.2 Billing
All subscriptions are processed and billed through Apple’s App Store. By subscribing, you agree to Apple’s payment terms. GENTIQ does not directly collect or store any payment or financial information.
5.3 Renewal and Cancellation
Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled at least 24 hours before the renewal date. You can manage or cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period — you will retain access to premium features until then.
5.4 Refunds
Refund requests are handled by Apple in accordance with their refund policy. GENTIQ does not process refunds directly. To request a refund, visit reportaproblem.apple.com.
5.5 Price Changes
We may adjust subscription pricing from time to time. Any price changes will be communicated in advance through the App Store. Existing subscribers will be notified before any change takes effect, and continued use after a price change constitutes acceptance of the new pricing.
6. Acceptable Use
You agree to use the Service only for lawful, personal, and non-commercial purposes. You may not:

7. User Content
7.1 Your Content
You retain ownership of all content you upload to the Service, including photographs of clothing items, selfies used for virtual try-on, and any other materials (“User Content”). By uploading User Content, you grant GENTIQ a limited, non-exclusive, worldwide, royalty-free license to process, store, and display your content solely for the purpose of providing the Service to you.
7.2 Responsibility
You are solely responsible for the User Content you upload. You represent and warrant that you own or have the necessary rights to upload such content and that it does not violate any third-party rights or applicable laws.
7.3 Deletion
You may delete individual wardrobe items or your entire account at any time. Upon deletion, we will remove your User Content from our active systems within 30 days, except where retention is required by law.
8. AI-Generated Content
GENTIQ uses artificial intelligence to generate outfit recommendations, item descriptions, style suggestions, and virtual try-on images (“AI Content”). You acknowledge and agree that:
9. Intellectual Property
The Service — including its design, code, branding, logos, AI models, and all other proprietary materials — is owned by GENTIQ and protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.
The GENTIQ name, logo, and all related marks are trademarks of GENTIQ UG (haftungsbeschränkt). You may not use these marks without our prior written consent.
10. Third-Party Services, Affiliate Links, and Retailer Purchases
10.1 Integrated third-party providers
The Service integrates with third-party providers (including Supabase, OpenAI, Google, Apple, Resend, and Meta Platforms, Inc.) to deliver its functionality. These providers operate under their own terms and privacy policies. GENTIQ is not responsible for the practices, availability, or content of any third-party services. Your use of features that rely on third-party services is subject to their respective terms.
10.2 Affiliate links and sponsored product recommendations
GENTIQ contains affiliate links. Any product link that may generate a commission for GENTIQ is clearly labelled as “Werbung”, “Advertisement”, or “Sponsored” at the point of tap. If you subsequently complete a purchase with the linked retailer, GENTIQ may receive a commission from the retailer or an intermediary affiliate network (currently Awin Ltd, UK, and/or Partnerize, UK). This commission comes at no additional cost to you.
The ranking and selection of recommended products within the Service is independent of commission rates. We surface items based on fit with your colour season, wardrobe, and occasion context, not based on which retailer pays us more. Further detail on how click attribution is processed is set out in our Privacy Policy, Section 13.
10.3 No liability for third-party purchases
When you tap an affiliate link you leave the GENTIQ app and enter a third-party retailer’s environment (opened inside an iOS SFSafariViewController). Any purchase you make is a contract exclusively between you and the respective retailer. GENTIQ is not a party to that contract, does not process the payment, does not ship or fulfil the goods, and makes no representations about the retailer’s products, prices, stock availability, delivery times, returns, warranties, or after-sales support.
GENTIQ accepts no liability — to the fullest extent permitted by applicable law — for: (i) the quality, safety, legality, or description of products offered by third-party retailers; (ii) the availability of advertised items; (iii) pricing accuracy or currency on retailer pages; (iv) order fulfilment, shipping, or delivery; (v) the retailer’s handling of returns, refunds, or warranty claims; or (vi) any other act or omission of a retailer or affiliate network. Disputes concerning a purchase must be pursued directly with the retailer in question.
Nothing in this clause excludes or limits liability that cannot be excluded or limited under mandatory applicable law (including Austrian / EU consumer protection law).
11. Availability and Modifications
11.1 Service Availability
We strive to keep the Service available at all times but do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control.
11.2 Changes to the Service
We reserve the right to modify, update, or discontinue any feature or aspect of the Service at any time, with or without notice. We will make reasonable efforts to notify users of material changes that significantly affect their use of the Service.
11.3 Changes to These Terms
We may revise these Terms from time to time. If we make material changes, we will notify you within the app or by email. The “Last Updated” date at the top of this document indicates when the most recent revision took effect. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, GENTIQ DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or free from errors or defects. We do not warrant the accuracy or reliability of any AI-generated content. Your use of the Service is at your sole risk.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GENTIQ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO GENTIQ IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR €50, WHICHEVER IS GREATER.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law. These limitations apply to the fullest extent permitted by law in your jurisdiction.
14. Indemnification
You agree to indemnify and hold harmless GENTIQ, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to your violation of these Terms, your use of the Service, or your User Content.
15. Termination
15.1 By You
You may terminate your account at any time by deleting it through the app via You → Settings → Delete Account, or by contacting us at contact@gentiqclo.com. If you have an active subscription, remember to cancel it through your Apple ID settings to avoid further charges.
15.2 By GENTIQ
We may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent or harmful activity, or if we are required to do so by law. Where reasonably possible, we will notify you before or at the time of termination.
15.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. We will delete your personal data in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) shall continue to apply.
16. Governing Law and Dispute Resolution
16.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Austria, without regard to its conflict of law principles. If you are a consumer residing in the EU, you also retain any mandatory protections provided by the laws of your country of residence.
16.2 Dispute Resolution
We encourage you to contact us first at contact@gentiqclo.com to resolve any disputes informally. If a dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the courts of Vienna, Austria, subject to any mandatory consumer protection provisions in your jurisdiction that grant you the right to bring proceedings in your local courts.
16.3 EU Online Dispute Resolution
The European Commission provides an Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and GENTIQ regarding your use of the Service. They supersede all prior agreements, understandings, or representations, whether written or oral.
